Top US Retailers Selling Non-FDA Compliant Cosmetics

A recent assessment by Registrar Corp, an FDA compliance company, has revealed that 48% of cosmetics companies importing to the top 25 US retailers are not compliant with the new FDA regulations. This alarming statistic indicates that approximately 135,000 products on the shelves of major US retailers may not meet the required safety standards.

The Retailers in the eye of the storm include Walmart ,Target ,CVS Pharmacy ,Walgreens ,Kroger, Amazon ,Costco , Sephora , Ulta Beauty and Dollar General .These retailers have been highlighted in the Registrar Corp assessment for having a significant number of imported cosmetics that do not meet the new FDA regulations under the Modernization of Cosmetics Regulation Act (MoCRA).

The Modernization of Cosmetics Regulation Act (MoCRA), enacted in December 2023, aims to enhance the safety and transparency of cosmetic products. Despite this, many retailers are struggling to ensure that the cosmetics on their shelves are FDA compliant. The assessment found that pharmacy chains had the highest compliance rate at 54%, while general merchandise chains had the lowest at only 32%.

The FDA has granted multiple extensions for cosmetic companies to comply with MoCRA requirements, but these extensions are set to expire on December 29, 2024. This assessment serves as a wake-up call for both retailers and cosmetic companies to prioritize compliance and ensure the safety of their products. Consumers deserve to have confidence in the safety and quality of the cosmetics they purchase.
